Terms & Conditions

Please read these terms carefully before engaging our services. They set out the basis on which Kheha provides family legal services and form part of the agreement between us and each client.

1. About Us

Kheha is a family legal services practice operating at 112 Rama IV Road, Khlong Toei, Bangkok 10110, Thailand. We provide legal services in relation to family matters to clients based in Thailand and to international clients with family legal needs that touch Thai law.

2. Our Services

We offer three primary service arrangements:

The precise scope of services to be provided will be set out in an engagement letter or service confirmation issued to you before work commences. Where the scope of your matter changes materially, we will discuss this with you and agree any variation in writing before proceeding.

Legal services are provided in English. Where documents are in Thai, we will provide explanation in English. Translation services into other languages are not included unless separately agreed.

3. Engaging Our Services

An engagement between you and Kheha begins when you have received and accepted our engagement letter and, where applicable, paid any required initial fee. No legal advice or representation relationship arises from an initial enquiry or from a consultation alone until a formal engagement is confirmed.

We reserve the right to decline any engagement at our discretion, including where a conflict of interest exists or where we assess that we are not the appropriate service provider for your needs.

By engaging our services, you confirm that you are aged 18 or over and, where you are engaging on behalf of another person, that you have the authority to do so.

4. Fees and Payment

Our fees for each service are set out in clause 2 above and confirmed in your engagement letter. Fees are stated in Thai Baht (฿) and are inclusive of Thai VAT where applicable.

Payment terms are set out in your engagement letter. Payments are typically required in advance of, or at the commencement of, the relevant service. We accept payment by bank transfer to the account details provided in your engagement letter.

For the Comprehensive Representation service, additional fees may apply where the matter extends beyond the initially agreed scope. We will discuss any such changes with you before they arise and will not incur additional costs without your prior agreement.

We do not offer a money-back arrangement as a matter of policy. If you have a concern about fees charged, we encourage you to raise it with us directly (see clause 10 on complaints).

Where payment is not received in accordance with the agreed terms, we may, after giving reasonable notice, suspend or withdraw from the engagement.

5. Your Responsibilities

To allow us to serve you well, we ask that you:

Where delays in your matter arise from a failure to provide timely instructions or information, we will not be responsible for those delays.

6. Confidentiality

We treat all information you share with us as confidential. We will not disclose your information to third parties except where you have given your consent, where disclosure is required by law, or where disclosure is necessary to provide your services (for example, to court or to opposing parties in proceedings, as part of the normal conduct of your matter).

Information shared with us in the course of legal advice is protected by legal professional privilege under Thai law. This is a right that belongs to you as the client, and we will uphold it.

7. Limitation of Liability

We will carry out your work with reasonable care and professional skill. However, the outcome of any legal matter depends on many factors outside our control, including the decisions of courts, the conduct of other parties, and changes in law. We do not make representations about the outcome of any matter.

Our liability to you is limited to direct losses arising from our negligence or breach of these terms. We are not liable for indirect, consequential, or speculative losses.

Nothing in these terms limits our liability for fraud or for any liability that cannot be excluded by law.

8. Intellectual Property

Legal documents, advice, and written work product prepared by us specifically for your matter belong to you upon receipt of full payment. General methodologies, templates, and know-how remain the property of Kheha.

All content on our website — including text, structure, and design — is the property of Kheha. It may not be reproduced without our written permission.

9. Termination

You may end your engagement with us at any time by written notice. You will remain responsible for fees for work completed up to the date of termination.

We may withdraw from an engagement where: you have not paid fees as agreed; you have provided us with materially inaccurate or misleading information; continuing would place us in breach of our professional obligations; or there has been a breakdown in the working relationship that makes it impractical to continue. We will provide reasonable notice where circumstances allow.

On termination, we will provide you with your file and any documents belonging to you, subject to any outstanding fees being settled.

10. Complaints

We take all concerns seriously and welcome the opportunity to resolve any issue directly. If you are unhappy with any aspect of our service, please contact us at [email protected] or by post to our office address. We will acknowledge your complaint within five working days and aim to provide a substantive response within twenty working days.

If you remain unsatisfied after we have addressed your complaint, you may seek guidance from the relevant professional body or regulatory authority applicable to legal practitioners in Thailand.

11. Governing Law

These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from or in connection with our engagement shall be subject to the jurisdiction of the courts of Thailand, with Bangkok as the agreed venue.

12. Changes to These Terms

We may update these terms from time to time. Where changes are material, we will note the updated date at the top of this page. The terms in force at the time your engagement commences will apply to that engagement unless we agree otherwise in writing.
